ARTICLE I
Section One: The Legislative Power of the ASSCCThe Legislative power of the ASSCC shall be vested in the Legislative Branch of the ASG
which consists of the Senate and the Cabinet. The Senate and the Cabinet shall legislate as a committee of the whole, meeting as prescribed according to the Bylaws. A majority shall constitute a quorum to do business.
1a. Meetings of the ASG and the ASSCC shall always be open to the public without exception. Meetings shall be run in accordance with Robert's Rules of Order, Newly Revised, except in cases that are in conflict with this Constitution and or Bylaws, at which time these documents shall prevail.
1b. All officers and senators shall make themselves available to the student body by holding two office hours per week.
Section Two: Minutes, Veto and Proxy Votes
The ASG shall keep minutes of all meetings, record the vote on any question at the desire of any member, and post minutes in a public place at least 72 hours in advance of the next meeting of the ASG. Any Senator or Officer of the ASG may introduce bills in writing.
2a. Every bill that passes the Legislative Branch shall, before it becomes a bylaw, be presented to the President of the ASSCC. If the President approves, the President shall sign the bill and it shall become a bylaw. However, if not, the President shall return all or any part of it, with the President’s written objections to the Legislative Branch, which shall enter the objections at large in the minutes and proceed to reconsider it. If, after such reconsideration, two thirds of the Legislative Branch agree to pass the bill, it shall become a bylaw. In all such cases the yeas and nays of the veto over-ride shall be recorded by roll call vote and entered in the minutes. Every order, resolution, or vote to which the concurrence of the Legislative Branch may be necessary shall be held according to the rules and limitations prescribed in the case of a bill.
2b. No proxy votes shall be allowed by any member under this Constitution.
Section Three: Officers and Senators - How Chosen
Members of the Senate and Officers of the Cabinet shall be elected by popular vote of the
students of Sacramento City College (SCC) according to the Bylaws.
Section Four: Duties and Authority of the Legislative Branch.
The Legislative Branch shall have the power and the authority to collect revenue from any
source prescribed according to the Bylaws and to pay all debts and provide for the common
welfare of the ASSCC.
4a. Appoint the Chief Justice of the Judicial Branch by open nomination and majority vote.
4b. Make bylaws, which shall be necessary and proper to carry out the business of the ASSCC.
4c. Fill all vacancies as may occur from resignations or removal from office of any position
under the authority of this Constitution and Bylaws by open nomination and majority vote of
the Legislative Branch.
4d. Adopt a budget and appropriate funds for the school year. No appropriation of money
shall be for a longer term than one school year. Money shall be drawn from the Treasury, in
appropriations made according to the Bylaws; a regular written statement and account of the
receipts and expenditures of all money shall be published every meeting.
Section Five: The Senate
The Senate shall be composed of fifteen Senators who shall serve for one school year starting
the day after the end of the spring semester. No person shall be a Senator who shall not have
attained and maintained a 2.0 grade point average, and be enrolled in less than six units at
SCC. The Vice President of the ASSCC shall be the President and Presiding Officer of the
Senate but shall have no vote unless the Senate is equally divided. The Senate shall choose
their other Officers, including a President Pro Tem in the absence of the Vice President or
when needed, to execute the office of the President. No Senator shall hold any other office
under the authority of the ASSCC. Each Senator shall have one vote when sitting in a session
of the Senate or with the Cabinet as a committee of the whole during sessions of the
Legislative Branch.
5a. The Senate has the power to propose any legislation to the Legislative Branch.
5b. Appoint one Associate Justice to the Judicial Branch by open nomination and majority
vote of the Senate.
5c. Issue any resolutions and hold hearings on any matter of concern to them.
Section Six: The Cabinet
The Cabinet shall consist of the Treasurer, Commissioner of Student Affairs, Commissioner
of the Inter-Club Council, Commissioner of Legislative Affairs, Commissioner of Public
Relations, Commissioner of Technology and Secretary. The Cabinet Officers shall serve for
one school year starting the day after the end of the spring semester.
6a. No person shall serve as Treasurer who shall not have had previous experience in
business accounting, bookkeeping, or have current enrollment in an accounting class. The
Commissioner of the Inter-Club Council shall serve as the President of the Inter-Club
Council (ICC). No person shall serve as Commissioner of ICC, who shall have not served as
an officer or member of the ICC for at least one prior semester. The ICC shall appoint one
Associate Justice to the Judicial Branch by open nomination and majority vote. The Secretary
is a voting member of the Cabinet and Legislative Branch, if the Secretary is elected or
appointed to office. If election or appointment cannot fill the office of Secretary, then the
ASG may hire a Secretary as a clerical position, in this case the Secretary shall have no vote.
6b. The Cabinet shall sit as an individual body only at the pleasure of and be presided over
by the President of the ASSCC, except when sitting with the Senate as a committee of the
whole as the Legislative Branch.
6c. No Cabinet Officer shall be elected/appointed who shall have not attained and maintained
a grade point average of 2.5, and have enrolled in less than six units at SCC. No Cabinet
Officer shall hold any other office under the authority of the ASG.
6d. The Cabinet Officers shall have authority and duties prescribed according to the Bylaws
and shall have the power to propose individual bills of legislation and budgets concerning
their departments and to appoint one Associate Justice to the Judicial Branch by open
nomination and majority vote. The Cabinet Officers shall have one vote per officer when
sitting in sessions of the Cabinet or as a committee of the whole with the Senate in sessions
of the Legislative Branch.
