ARTICLE II
Section One: The ExecutiveThe Executive power of the ASSCC shall be vested in the President of the ASSCC. The President and Vice President shall be elected by a majority of the popular vote of the students of SCC, and shall serve for one year starting the day after the end of the spring semester.
1a. No person shall serve as President or Vice President who has not attained and maintained a 2.5 grade point average; who is enrolled in less than six units; who has completed less than twelve units before the election; and who has not served as a member at least one prior semester in the ASG at SCC.
1b. The President and Vice President shall hold no other office under the authority of the ASSCC. In the case of the removal of the President from office, or of the President’s death, resignation, or inability to discharge the powers and duties of the said office, the same shall devolve on the Vice President. The Legislative Branch may, according to the Bylaws, provide for the case of removal, death, resignation or inability of both the President and Vice President; declaring what officer shall then be President and such officer shall act accordingly until the inability be removed or a President be elected.
1c. Before the President Elect shall enter on the execution of his office, the following oath or affirmation shall be administered: “I, (state name), on behalf of the Associated Students of Sacramento City College and in recognition of my election/appointment to the Associated Student Government, solemnly swear to represent the student body to the best of my ability. I willingly accept the responsibilities of my office and take this oath as a firm commitment to fulfill the obligations pertaining to that office and to support and abide by the Constitution of the Associated Students of Sacramento City College.”
Section Two: Duties and Authority of the Executive Branch
The President is the Chief Executive of the ASSCC, shall be the Presiding Officer of sessions of the Legislative Branch, and shall have a vote only if the Legislative Branch becomes evenly divided.
2a. The President shall have power to set all agendas, which shall be publicly posted no later than 72 hours before the beginning of a regular session of the Legislative Branch. The President may require in writing the opinion of the Executive Officers of the Cabinet upon any subject relating to the duties of their respective offices.
2b. The President shall have power, by and with the advice and consent of two-thirds of the Legislative Branch, to make agreements or enter contracts.
2c. The President shall nominate one Associate Justice to the Judicial Branch, emissaries, committees and their chairpersons with the advice and consent of a majority of the Legislative Branch. However, the Legislative Branch may vest the appointment of said emissaries, committees and their chairpersons, as they think proper, in the President alone,with a majority vote.
2d. The President shall have power to fill all vacancies that may happen in between meetings of the Legislative Branch, by granting commissions, which will expire at the beginning of the next session.
2e. The Vice President shall have one vote during a session of the Legislative Branch.
Section Three: Special meetings, Chief Spokesperson and Legislation
The President shall from time to time give to the Legislative Branch information on the state of the Association and recommend for their consideration such measures as the President shall judge necessary and expedient.
3a. The President may, on extraordinary or special occasions, convene the Legislative Branch as long as the agenda is publicly posted no later than 24 hours before the session is convened.
3b. The President shall receive all visiting emissaries, dignitaries, and other representatives, being the Chief Spokesperson for the ASSCC.
