ARTICLE IV
Section One: Removal from OfficeThe President, Vice President, Senators, Commissioners, and Justices of the ASG shall be removed from office on impeachment for and conviction of any illegal behavior while fulfilling the duties of his/her position, including representing the ASSCC at any time or while on SCC grounds. Gross negligence of his/her official duties may also justify removal. Gross negligence includes failure to comply with the ASSCC Bylaws, Attendance Section, or to meet the eligibility requirements of his/her position violating this Constitution and Bylaws.
Impeachment proceedings may be brought by any member of the ASG by application to the impartial Judicial Branch. The application shall be in writing and contain the name and position of only one officer for impeachment and the specific violation for which the
impeachment procedures are being called. Upon receiving an Impeachment Application, the Judicial Branch shall convene immediately and hear all testimony and evidence in open session. If a member of the Judicial Branch is deemed partial, that Justice shall be recused from the proceedings. A majority vote of the Justices other than the Justice accused of impartiality is needed to recuse a Justice.
2a. No Officer shall be impeached if a majority of the Justices do not concur that there is
sufficient evidence or cause to convene an impeachment hearing. However, a majority of the Justices may concur on a lesser sanction other than impeachment if the officer or senator agrees.
2b. If a majority of the Justices concur that there is sufficient evidence or cause for an
impeachment hearing, then a hearing shall be convened with the Chief Justice presiding and the Legislative Branch sitting under oath or affirmation as the panel of impeachment. No member of the Legislative Branch shall sit on the panel of impeachment if they are
signatories on the Application of Impeachment, witnesses, or the member under
impeachment. Upon completion of impeachment procedures, the member may then be impeached by a three-fourths affirmative vote of the ASG.
2c. The member(s) bringing the Application of Impeachment shall serve as the
complainant(s).
2d. The member impeached shall have the following rights:
1. Understand the written charges.
2. Be represented and aided by council of their choosing in their defense; however,
no professional member of the bar (lawyers) will be allowed.
3. Confront their accusers and question them in open session.
4. Discover the evidence against them.
5. Not be compelled to be a witness against him or herself.
6. Produce witnesses and evidence in their defense.
7. Challenge a member of the panel of impeachment for just cause. The Chief
Justice shall have final determination of a successful challenge for just cause.
2e. These rights shall extend to all students, student clubs or associations or organizations that shall be a party to a matter before the Judicial Branch.
