AJ300 MIDTERM PROJECT
do not begin this project until you have been given instructions!!!
Based on a case study, you will identify characteristics of a specific crime. Upon completing this project, you will have the ability to identify various characteristics of a specific crime. In addition, you will be able to subjectively argue this case by preparing both a defense and prosecutorial argument to be used in the ‘pre-trial activities’
This midterm project will examine your ability to identify certain characteristics as defined in the project objectives listed below. You will read a case study of a crime and review the police reports of a very specific crime.
Your responses to each objective should relate to the case sample, the crime reports and to your readings in the text. Students are to reference the author and page numbers when relating your responses to the text (example: when quoting from the text, follow the paragraph or sentence with: (Schmalleger, p. #). Make sure to include a separate bibliography page acknowledging your references.
Type your answers using double space format on separate sheets of paper. Ensure proper grammar and spelling prior to turning the project in.
Project Objectives:
1. Determine ‘corpus delicti’ – Identify the ‘body’ of the crime
2. Identify the statutory ‘elements’ of this specific crime
(Example of an element of auto theft):
a. “an unlawful taking of a vehicle”
3. Identify the ‘general features’ and ‘other features’ of this crime (ex: actus reus, causation, harm, etc.)
a. as part of the ‘principle of legality, name the specific offense identified in this case (ex: 10851(a) Vehicle Code (VC)
b. as part of the ‘principle of punishment’, name the punishment that accompanies that specific offense
(this is found in the Vehicle Code Section of 10851(a) VC)
4. Identify the ‘general category’ of the offense identified in this case
5. Based on the case study, prepare a ‘defense’ for the case as if you are the defense attorney assigned to the case. USE A MINIMUM OF 500 WORDS FOR THE DEFENSE SECTION.
In other words:
a. What and type of defense will you attempt to use to defend the accused? (also list the specific name of the defense you are going to use: ex: self- defense)
b. What type of supporting evidence from the case study will help you to prove this defense?
6. Based on the case study information and the evidence presented by the Defense, prepare an argument for the prosecution to prove, beyond a reasonable doubt, that the defense theory is wrong.
